So today was somewhat frustrating. I had been ignored for 3 days by the above body shop. I had paid 800 up to day to get my car sorted. But John who owns Q11 decided to sell up shop and bail on all his customers including me. Then charged me 100 pounds to get her out. Then I called another shop to come collect her, he looked at it and shook his head. I'm in a rage. John had my skyline for 3 months and also ****ed up my break lights.

I hope big cheif you this this and kick and ban that self absorbed little ****** for me I hope you do.

Basicly I was fooled and blinded by this guy.

Found out he is moving all his **** due to dodging creditors....

I can't tell you how upset I am with this all.

Never ever will I use this again

:(

I paid some upfront then as and when he needed something i gave him more. I guess i trusted the guy.

So lemme update u on whats happened........

I was looking over his invoice (which he states is a legal document) this has my payments made, and sighed. SOOO this is where it gets interesting :)

I called trading standards and they advised the following....

Be seen as calm and negotiable and fair
prove his work is below standards by getting an external garage to look it over and agreed
also he breached the agreement when he agreed 3 weeks and it ran on 3 months

so on those 3 points the paint has started to flake off, the silver he use doesnt match my old silver (not even close), the paints peeling off already
the brake lights are dammaged and not working, he dammaged exsisting panels that didnt need work.
the fitment of the things he put back on is below standard and forced on. (this has all been noted by new garage)

so the cars in a worse state than before it went in.

THUS stipulations under the Supply of Goods and Services Act 1982 and the Sale and Supply of Goods to Consumers Regulations 2002 for the work to be: of satisfactory quality; completed with reasonable care and skill; and in a reasonable time.

so trading standards said to write him a letter (i have emailed to his personal and work email, then text saying you have an email, im also in the process of getting his personal addy to send him the same thing (recorded thro royal mail) and my letter goes alittle like this ...

Having had the work you did on my Nissan Skyline registration N346 LAG assessed by another professional body shop, and having consulted with Trading Standards over the results, the conclusion is that the work is below acceptable standards and unfit for purpose (I list the specific issues at the end of this email).

As such, I am in the process of taking legal advice on recovering the considerable sum already paid for this work. Please be especially aware of the stipulations under the Supply of Goods and Services Act 1982 and the Sale and Supply of Goods to Consumers Regulations 2002 for the work to be: of satisfactory quality; completed with reasonable care and skill; and in a reasonable time.

In the interests of fairness and compromise I first wish to give you the opportunity to provide restitution under the terms of your '12 months guarantee' as stated on the quotation of work dated 01/09/2012 (see attached document).

I am willing to negotiate on the sum total of £900 paid, however, due to both the excessive length of time the original work took and the unfinished and sub-standard nature of that work as listed below, I am not willing to return the vehicle to you or have you continue working on it.

Please note that should this come to legal action I would also be entitled to claim for the cost of having another body shop redo the work to an acceptable standard. I hope we can resolve this issue without that becoming necessary.

I believe I have been reasonable to this point giving you time to complete the work satisfactorily, even considering your difficulties with your landlord during September 2012 when my vehicle actually became inaccessible.

Please respond to this email at your earliest convenience so that we can discuss the level of recompense required.

Lance Robinson.

Issues Identified (including but not exclusively):

1. Original time-frame of circa. 3 weeks exceeded by around 2 months at which time work was incomplete.

2. Bespoke paintwork unfinished and of unacceptable quality (details available on request).

3. Window seals not removed so that lacquer work is on the rubber and already flaking off taking paint with it.

4. Mopping/polishing work excessive to the point of polishing through lacquer and paint layers.

5. Colours used do not match to original silver.

6. Underseal incomplete.

7. Engine bay treatment incomplete.

8. Side skirts loose and not sealed.

9. Spats loose and not sealed.

10. Original rear bumper and spats damaged.

11. Brake lights damaged and no longer working.

This shows me as calm and fair, i also have a CAB appointment next weds 12th to see where i stand on the legal front.

So basicly if he doesnt play ball and this doesnt work .... im going to take more extreme measures (not for over here tho)

Thoughts on this please :)

Cheers

L

Very well written mate.

If that doesn't work then I suggest you find out just how far you can shove a 50kg dumbell up his arse. ;)
